  1. These terms
    • These terms and conditions relate to any products supplied to you through this website (“the Site”) by The Perfect Wine List Ltd trading as The Perfect Wine List (“The Perfect Wine List”, “we” or “us”) to you, the customer or Site user (“you”). These terms and conditions together with the receipt of order and dispatch emails we send to you will form the agreement between you and us (“the Agreement”).
    • Please read these terms carefully to ensure you understand them. Before placing an order on this Site you will be asked to agree to these Terms. If you have any questions about these Terms, please contact us to discuss.
    • These terms and conditions may be varied by us at any time by posting amended terms and conditions on the Site. The terms and conditions which apply to your purchase will be those terms and conditions applicable at the time of the purchase.
    • These terms and conditions relate to your purchases from us through the Site but do not relate to your use of the Site otherwise. Please also see our Privacy and Data Protection Policy for information about how we collect and use your personal data and our Cookies Policy for information about cookies.

    • We are the The Perfect Wine List Ltd and we operate and maintain the Site. We are registered in England and Wales under company number 09922177. Our registered office is at 86-90 Paul Street, London, EC2A 4NE

  3. Registration and passwords
    • In order to place an order or start a subscription with the Site you will be required to create an account and submit specific information.
    • All the information you provide must be truthful and you should take care that the password you create is protected at all times. The protection of your password is your responsibility and you are solely responsible for the unauthorised use of your password or unauthorised access to your account. We may suspend or terminate your access to the Site at any time with or without notice. To understand how we use the information that we collect from you, please read our Privacy Policy.
  4. Subscriptions
    • Our service is a subscription-based wine delivery service, please note that once you have purchased a subscription then after the cancellation period (which is described in our cancellation policy) you will not be entitled to cancel your subscription until the end of the minimum period of your subscription, at the end of that minimum period you may cancel your subscription by giving one months’ notice. If you have selected a subscription for a fixed period, the minimum period will be the term of the subscription and your subscription may terminate automatically at the end of that period.
    • When you set up your subscription you will need to specify your account settings such as the type of wine you would like us to deliver, the quantity and the subscription length. We will select wines for delivery to you based on your account settings. You can change your wine preference in your account settings from month to month (but you may not reduce the quantity of wines purchased or the subscription period until the end of your subscription).
    • By purchasing a monthly subscription, you acknowledge that your subscription has an initial and recurring payment. You accept responsibility for all recurring charges prior to cancellation. Your subscription will last for the number of months that you select when you place your order and it will not automatically renew once the subscription term has ended
  5. Signing Up or Placing an Order
    • As well as our subscription service, you may also place orders for additional bottles of wine in quantities of 6 or 12 bottles.
    • Please view the Site which explains how to place an order either to purchase specific wines or set up a subscription. Our process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.
    • After you place an order, you will receive an e-mail from us acknowledging that we have received your order. However, please note that this does not mean that your order has been accepted.
    • We will confirm our acceptance of a one-off order or a subscription to you by sending you a confirmation e-mail confirming that the products have been dispatched or the subscription set up (“Confirmation”). The Contract between us will only be formed when we send you the Confirmation.
    • If we are unable to supply you with a given product for an order, for example if you ordered a specific product for a one off order and that product is not in stock or no longer available or because we cannot meet your requested delivery date or because of an error in the price on our site, we will inform you of this by e-mail and we will not process your order. If you have already paid for the products, we will refund you the full amount charged as soon as possible.
    • We only sell products to the UK. Unfortunately, we do not accept orders from or deliver to addresses outside the UK.
  6. Payment and prices
    • At the time you place an order you must give authority for payment. We may take payment from you at any time between you placing the order and us accepting your order.
    • You will enter your card details when you place your order and the initial payment will be taken when we have accepted your order. For subscriptions, the same payment card will be automatically charged on a monthly basis for the duration of your subscription.
    • The prices payable for the items that you order and our subscription charges are clearly set out on the Site. If, by mistake, we have under-priced an item or a subscription, we will not be liable to supply that item or that service to you at the stated price provided that we notify you before we accept your order.
    • The price of a product includes VAT (where applicable) at the applicable current rate chargeable in the UK for the time being. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the products in full before the change in VAT takes effect.
    • The price of a product or subscription includes delivery charges.
  7. Introductory Trial Period
    • Our introductory trial offer is only available to new users of the website. The introductory trial allows you to order one case of wine to see the type of products provided without purchasing a subscription. We reserve the right to withdraw or refuse a trial for any reason.
  8. Availability and Products
    • Any order you may place with us is subject to the availability of the products ordered. We cannot and do not guarantee that any item shown on the Site will be available continuously or at any given time.
    • If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you except to ensure that you are not charged for that item.
    • We reserve the right to limit the amount of products that you order.
    • The products on our site are only available to persons who are 18 years of age or older. We are not allowed by law to supply alcohol to you if you do not satisfy these age requirements. Before placing an order on this site you will be asked to confirm that you are 18 years of age or older. Our delivery driver may ask you to produce some form of ID. If you are unable to verify your age, our driver will be unable to deliver the wine.
    • The packaging of the products may vary from that shown on images on our site.
    • The images of the products on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflect the colour of the products. Your products may vary slightly from those images.
    • We do not warrant taste or drinkability of wines purchased as drinkability and taste are subjective judgements.
  9. Your rights to make changes
    • If you wish to make a change to the subscription you have ordered please login to your account and contact us. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the product, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.
  10. Delivery
    • Delivery will be made to the address specified by you on the completed order form.
    • During the order process we will let you know when we will provide the products to you. If you have ordered a subscription, we will also tell you during the order process when and how you can end the contract.
  11. If we are unable to provide an exact date of delivery we will endeavour to provide you with an approximate delivery time when you place the order and we or our delivery partners will contact you again when we are able to specify a date.
    • Our delivery requires a proof of signature and cannot be left for you without this. If you are not in at the specified delivery time, we will [leave a note/email you] informing you of how to rearrange delivery.
    • If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will minimise the effect of the delay. We will not be liable if we fail to deliver in part or in full due to circumstances beyond our control.
    • Whilst we will use reasonable endeavours to deliver the items on the agreed date we will not be liable for any failure to deliver on the stated date or at the stated time.
    • If you do not pay us for your monthly subscription when you are supposed to we will email you to notify you that your subscription will be suspended. We will resume your subscription when we have received payment. We will not charge you for the products during the period for which they are suspended.
  12. Your Right to Cancel
    • For one-off orders (that is orders which are not part of a subscription) you can cancel or change any of your current orders prior to dispatch by logging into your account or contacting us on support@perfectwinelist.com
    • Please see our returns and cancellation policy which explains your right to cancel your subscription or a contract for the one-off purchase of products without giving a reason and how you can exercise that right.
    • Personalised or perishable items or items with a hygiene element may not be returned unless they are defective.
    • Under the Consumer Rights Act 2015 any products supplied must be as described, fit for purpose and of satisfactory quality.
    • If you wish to exercise your legal rights to reject faulty products you must tell us within a reasonable time of discovering the defect (and if the defect is reasonably apparent immediately then you must tell us within 30 days). You will then need to return the product in person, post it back to us or (if they are not suitable for posting) allow us to collect them from you. We will pay the costs of postage or collection.
  13. Our Liability
    • Where items are sold under a consumer transaction your rights which you are entitled to as a matter of law under the Consumer Rights Act or other legislation are not affected by any of these terms and conditions.
    • Any claim by you which is based on any defect in the quality of the products supplied or their failure to correspond with specification must be notified to us as soon as possible from the date of delivery (and in any case, within 30 days of delivery) or (where the defect or failure was not apparent on reasonable inspection) within a reasonable time after discovery of the defect or failure. If you do not notify us accordingly, you will not be entitled to reject the products and we shall have no liability for such defect or failure.
    • Where any valid claim in respect of any of the items supplied which is based on any defect in the quality or condition or their failure to meet its specification is notified to us in accordance with these terms and conditions, we shall replace the items free of charge or refund to you the price of the item, but we shall have no further liability to you.
    • We shall not be liable to you by reason of any representation, or any implied warranty, condition or other term or any duty at common law, or under the express terms of these terms or this Agreement, for any consequential loss or damage (whether for lost profit, lost opportunity or lost reputation or otherwise), costs expenses or other claims for consequential compensation whatsoever (and whether caused by our negligence, our employees or agents or otherwise) which arise out of or in connection with the supply of products or their use or resale by you, except as expressly provided in these conditions.
    • Our entire liability under or in connection with these terms and conditions shall not exceed the price of the items supplied.
    • Nothing in this clause 13 or any other of these terms and conditions will exclude or limit our liability in respect of death or personal injury caused by our negligence.
  14. General
    • These terms and conditions and this Agreement will be subject to the laws of England and Wales. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.
    • If you are not a consumer, you confirm that you have authority to bind any business on whose behalf you use our site to purchase products.
    • We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms.
    • This Contract is between you and us. No other person shall have any rights to enforce any of its terms
    • Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
    • If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations.
    • We shall not be responsible for any breach of these terms and conditions caused by circumstances beyond our reasonable control.
